Three judges on Poland's Constitutional Court have ruled that same-sex marriages contracted abroad cannot be recognised in Poland, directly targeting a ministerial decree that had sought to allow their registration in Polish civil records. The decree, issued by Digitalisation Minister Krzysztof Gawkowski, was designed to implement a European Court of Justice ruling requiring EU member states to recognise same-sex unions for the purpose of freedom of movement within the Schengen area. The Polish government is dismissing the ruling as legally void, arguing the court is itself illegitimate — a position backed by a 2025 ECJ finding that the tribunal's composition violates constitutional and EU norms — and has instructed civil registry offices to continue processing the transcriptions of foreign same-sex marriages.
